You retain copyright on anything of yours we publish, but you give us the right to publish your work as we see fit. BEFORE you send us anything, please read the full agreement below.

THE CONTRIBUTION: ALL MATERIALS (INCLUDING PHOTOGRAPHS) SUBMITTED TO FANCYAPINT LTD FOR PUBLICATION.

THE AUTHOR: THE PERSON (OR PERSONS) NAMED IN THE "AUTHOR' FIELD IN THE REVIEW SUBMISSION FORM - EITHER THE AUTHOR"S REAL NAME OR THE RECOGNISED FANCYAPINT ALIAS HE OR SHE USES IN REVIEWS

LICENCE TO PUBLISH THE CONTRIBUTION

 

To: FANCYAPINT LTD

1. In consideration of FANCYAPINT LTD agreeing to publish the Contribution, the Author grants to FANCYAPINT LTD for the full term of copyright in the Contribution and any extensions thereto, subject to clause 2 below, the non-exclusive licence

(a) to publish, reproduce, distribute, display and store the Contribution in all forms, formats and media whether now known or hereafter developed (including without limitation in print, digital and electronic form) throughout the world,

(b) to translate the Contribution into other languages, create adaptations, summaries or extracts of the Contribution or other derivative works based on the Contribution and exercise all of the rights set forth in (a) above in such translations, adaptations, summaries, extracts and derivative works and

(c) to license others to do any or all of the above.

 

2. Ownership of copyright remains with the Author. The Author retains the non-exclusive right to reproduce the Contribution in whole or in part, in any printed work or electronic publication provided that, when reproducing the Contribution or extracts from it, the Author acknowledges first publication in FANCYAPINT.COM.

 

3. The Author warrants and represents that:

(a) The person named in the "AUTHOR" field of the submission is the genuine author of the contribution.

(b) By submitting the Contribution to Fancyapint Ltd, the Author accepts the terms and conditions of this agreement.

(c) The person submitting the Contribution has the Author's permission to do so.

(d) The Author is the sole author of and sole owner of the copyright in the Contribution. If the Contribution includes materials of others, the Author has obtained the permission of the owners of the copyright in all such materials to enable them to grant the rights contained herein. Copies of all such permissions are attached to the Contribution.

(e) All of the facts contained in the Contribution are true and accurate.

(f) The Author who has signed this Agreement has full right, power and authority to enter into this Agreement.

(g) Nothing in the Contribution is obscene, defamatory, libelous, violates any right of privacy or infringes any intellectual property rights (including without limitation copyright, patent or trademark) or any other human, personal or other rights of any person or entity or is otherwise unlawful. e) Nothing in the Contribution infringes any duty of confidentiality which the Author may owe to anyone else or violates any contract, express or implied, of the Author.

 

4. The Author authorises FANCYAPINT LTD to take such steps as it considers necessary at its own expense in the Author’s name and on his or her behalf if it believes that a third party is infringing or is likely to infringe copyright in the Contribution.

 

5. The Author hereby consents to the inclusion of electronic links from the Contribution to third-party material wherever it may be located.

 

6. This Agreement shall be governed by and construed in accordance with the laws of England without regard to the principles of conflicts of law. The parties hereto submit to the non-exclusive jurisdiction of the English courts.

 

7. The author in consideration of the publication of CONTRIBUTION also understands:

(a) FANCYAPINT LTD will have the right to edit the work, provided that the meaning of the text is not materially altered.

(b) This Agreement represents the entire understanding between the parties hereto with respect to the subject matter hereof and this Agreement supersedes all previous representations, understandings of agreements, oral or written, between the parties with respect to subject matter hereof and cannot be modified except by a written instrument signed by the parties hereto.

(c) This Agreement shall be binding upon the parties hereto, their heirs, successors, assigns and personal representatives.

(d) This agreement applies to all past and future materials submitted for publication by the Author to FANCYAPINT LTD.
